শ্রী গগৈ’র মনোনয়ন বাতিল করতে হবে

ভারতের কমিউনিস্ট পার্টি (মার্কসবাদী)’র পলিট ব্যুরো নিম্নলিখিত বিবৃতি দিয়েছে

ভারতের প্রাক্তন প্রধান বিচারপতি শ্রী রঞ্জন গগৈ’কে মোদী সরকার রাজ্যসভায় মনোনীত করেছে, সিপিআই(এম) পলিট ব্যুরো এই কাজের দৃঢ় প্রতিবাদ করছে। প্রাক্তন প্রধান বিচারপতিকে রাজ্যসভায় মনোনীত করার মধ্যে দিয়ে মোদী সরকার নির্লজ্জ্বভাবে দেশের বিচারব্যাবস্থার স্বাধীনতা ধ্বংস করছে এবং একইসাথে আমাদের দেশের সংবিধানে সন্নিবিষ্ট অলঙ্ঘনীয় নীতি হিসাবে রাষ্ট্রের বিভিন্ন প্রতিষ্ঠানগুলির মধ্যে যেভাবে ক্ষমতার বণ্টন করা রয়েছে সেই বিন্যাসকে নষ্ট করে দেওয়া হচ্ছে। হাস্যকর ব্যাপার এই যে গত বছর প্রধান বিচারপতি হিসাবে কাজ কর্তব্যরত থাকার সময় গগৈ নিজস্ব ব্যানে উল্লেখ করেছিলেন “একটি সমর্থ দৃষ্টিভঙ্গির দ্বারা বলা যায় বিচারপতিদের অবসরোত্তর নিয়োগ, বিচারব্যাবস্থার স্বাধীনতায় একটি ক্ষত বিশেষ”।

দ্বিধাহীনভাবে সিপিআই(এম) আগেই জানিয়েছে, দেশের সাংবিধানিক নীতির অধীনে থাকা ভারতের বিচারব্যাবস্থা শুধুমাত্র স্বাধীনই নয়, আইনের শাসন কায়েম রাখতে তার গুরুত্বপুর্ণ ভূমিকা রয়েছে। সম্প্রতি বিভিন্ন ক্ষেত্রে ন্যায়বিচার পেতে বিলম্ব হওয়া, মধ্যরাত্রে হাইকোর্টের বিচারপতিদের অন্যত্র অপসারণ, ধারা ৩৭০ কে রদ করার বিরুদ্ধে এবং সিএএ নিয়ে দাখিল করা মামলায় দেরি হওয়ার ঘটনাবলি জনগণের ভরসা জাগাতে পারেনি এবং তাদের ন্যায্য আশাপূরণের সাথেও অসংগতি দেখিয়েছে।

জনমানসে ব্যাপ্ত একটি সমালোচনা চলছে যে দেশের বিচারব্যাবস্থার উপরে আইনের কার্যনির্বাহীদের দ্বারা চাপ সৃষ্টি করা হচ্ছে এবং এর দ্বারা বিচারব্যাবস্থাকে নিজের কর্তব্য পালনে অপারগ করে তোলা হচ্ছে - এই আলোকেই পলিট ব্যুরো সরকারের পক্ষ থেকে প্রাক্তন প্রধান বিচারপতিকে রাজ্যসভায় মনোনীত করার ঘটনাকে বিচার করছে এবং এই ঘটনার তীব্র বিরোধিতা জানাচ্ছে। দেশের সংবিধানের মর্মবস্তুর স্বার্থে এই প্রবণতা ত্বরিত সঠিক দিশায় আনা দরকার। তাই, ভারতের রাষ্ট্রপতির কাছে পলিট ব্যুরোর আবেদন, শ্রী গগৈ’র মনোনয়ন বাতিল করতে হবে।

Rescind Nomination of Ranjan Gogoi

The Polit Bureau of the Communist Party of India (Marxist) has issued the following statement:

The Polit Bureau of the CPI(M) expresses its firm objection to the nomination of Shri Ranjan Gogoi, former Chief Justice of India (CJI), to Rajya Sabha by the Modi government. By nominating the former CJI to the Rajya Sabha, the Modi government is brazenly undermining the independence of the judiciary and subverting the separation of powers between the organs of the State, which is an inviolable principle enshrined in our Constitutional scheme.  Ironically, last year itself, then CJI Gogoi had observed: “There is a strong viewpoint that post-retirement appointment is a scar on independence of judiciary”. 

The CPI(M) has earlier stated in no uncertain terms that under the Constitutional Scheme of things, the judiciary in India is not only independent, but has a very important role to safeguard the rule of law.  The recent delays in delivery of justice, mid-night transfers of High Court judges and the delay in taking up the challenges to abrogation of Article 370 and the CAA have not evoked confidence among the people and are not in consonance with their legitimate expectations.

The Polit Bureau is firmly opposing the move by the government in the light of widespread criticism that judiciary is being pressurized by the Executive and abdicating its responsibility.  In the interest of our Constitutional spirit, this trend must be set right urgently.  Therefore, the Polit Bureau urges the President of India to rescind the nomination of Shri Gogoi.
