এসসি-এসটি আইনের প্রযোজ্যতা নিয়ে সুপ্রিম কোর্টের রায়ে গভীর উদ্বেগ প্রকাশ করা হচ্ছে

ভারতের কমিউনিস্ট পার্টি (মার্কসবাদী)-এর পলিট ব্যুরো নিম্নলিখিত বিবৃতি প্রকাশ করেছে:

ভারতের কমিউনিস্ট পার্টি (মার্কসবাদী)-এর পলিট ব্যুরো সুপ্রিম কোর্টের দুই বিচারপতির বেঞ্চের দেওয়া রায় নিয়ে গভীর উদ্বেগ প্রকাশ করছে। ওই রায় অনুযায়ী: “এসসি/এসটি আইনের ৩(১)(আর) এবং/অথবা ৩(১)(এস) ধারার অধীনে অপরাধ সংগঠিত হয়েছে তা প্রমাণ করতে হলে, জাতিগত গালিগালাজ বা লাঞ্ছনার ঘটনাটি অবশ্যই ‘জনসমক্ষে’ (within public view) ঘটতে হবে। এটি এমন একটি স্থান হতে হবে যা সাধারণ মানুষের দৃষ্টিগোচরের মধ্যে থাকে। এমনকি যদি এটি কোনো ব্যক্তিগত স্থানও হয়, তবে সেখানে সাধারণ মানুষের প্রবেশের সুযোগ থাকতে হবে যাতে সেখানে কী ঘটছে তা তারা লক্ষ্য করতে পারে; তবেই সেটি ‘জনসমক্ষে থাকা স্থান’ হিসেবে গণ্য হবে।” দুর্ভাগ্যজনকভাবে, গিরিজা কুমারী ও অন্যান্য বনাম দিল্লি রাজ্য মামলায় সুপ্রিম কোর্ট একটি সংকীর্ণ ও অতিরিক্ত আইনকেন্দ্রিক দৃষ্টিভঙ্গি গ্রহণ করে এফআইআর ও চার্জশিট খারিজ করার নির্দেশ দিয়েছে।

এই রায়টি বেশ কিছু কারণে উদ্বেগের বিষয়। প্রথমত, এটি এমন এক সময়ে এসেছে যখন দেশের অধিকাংশ অংশে তফশিলি জাতি (SC) এবং তফশিলি উপজাতি (ST) সম্প্রদায়ের মানুষের বিরুদ্ধে অত্যাচারের ঘটনা উদ্বেগজনকভাবে বৃদ্ধি পাচ্ছে। দ্বিতীয়ত, এই রায়টি সুপ্রিম কোর্টের সেই ধারাবাহিক রায় ও মন্তব্যের সাম্প্রতিকতম সংযোজন যা এই সম্প্রদায়ের সদস্যদের অধিকারকে নেতিবাচকভাবে প্রভাবিত করে। এটি অত্যন্ত বেদনাদায়ক হবে যদি এই রায়ের ফলে বাড়ি, অফিস, স্কুল, কলেজ বা অন্য কোনো স্থানে এসসি-এসটি ব্যক্তিদের জনপরিসরের ব্যক্তিগত অংশে অপমান বা লাঞ্ছনা করার ঘটনা বৃদ্ধি পায়—কেবল এই কারণে যে অপরাধীরা মনে করবে যে তারা আইনের চোখে শাস্তি থেকে ছাড় পেয়ে যাবে।

সিপিআই(এম) কেন্দ্রীয় সরকারের কাছে দাবি জানাচ্ছে যে তারা অবিলম্বে হস্তক্ষেপ করুক এবং সুপ্রিম কোর্টকে এই রায় পুনর্বিবেচনার জন্য আবেদন জানাক।

The Polit Bureau of the Communist Party of India (Marxist) has issued the following statement:

Grave Concern over SC Judgement on Applicability of SC-ST Act

The Polit Bureau of the Communist Party of India (Marxist) expresses grave concern over the judgement passed by a two-judge bench of the Supreme Court according to which “In order to make out the offence under Section 3(1)(r) and/or Section 3(1)(s) of the SC/ST Act, the occurrence of the incident and the act and conduct of hurling of caste-based abuses must take place at ‘a place within public view’. It must be a place within the public gaze. Even if it happens to be a private place, then in such eventuality, a public eye must have an access to be able to notice what happens there or what is taking place that will only make the ‘place within public view’.” Unfortunately, the SC in the Girija Kumari & Others v/s State of Delhi adopted a narrow, legalistic view and ordered that the FIR and charge-sheet be quashed.

This ruling is a matter of concern for several reasons. For one, it comes at a time when atrocities against people belonging to the SC and ST communities are seeing an exponential rise in most parts of the country. Secondly, the judgment is the latest in a series of SC judgments and pronouncements which adversely impact the rights of members of these communities. It would be tragic if this latest judgment increases incidents of humiliation and abuse of SC and ST persons in the privacy of homes, offices, schools, colleges and such other public spaces because perpetrators believe that it confers them with impunity before the law.

The CPI(M) demands the union government to immediately intervene and appeal the Supreme Court to revisit the judgement.
